GENERAL TERMS AND CONDITIONS OF BUSINESS
1. Terms and Conditions
1.1 All and any business undertaken by EASYKOMAS Limited is transacted subject to the terms and conditions hereinafter set out, each of which will be incorporated or implied in any agreement between EASYKOMAS and the distributor/franchisee, customer, client, or user.
1.2 In the event of a conflict between these terms and conditions and any other terms and conditions, the former shall prevail unless otherwise expressly agreed by EASYKOMAS in writing yet General Disclaimer stands.
1.3 EASYKOMAS is a corporate legal entity or person separated from the owner(s), the management, and staff members. An amendment to these terms and conditions can be done by the company or an authorised representative of EASYKOMAS without any form of notice to the distributor/franchisee, customer, client, or user and the general public; who therefore consent to get updated regularly through our online platform (www.easykomas.com).
1.4 The distributor/franchisee, customer, client, or user is deemed to have accepted our terms and conditions of business upon any interaction with our online platform, app, or any material or human representative of EASYKOMAS.
“Distributor or Franchisee”
This means any person, firm or body corporate together with any subsidiary, group or associated company with a business relationship with EASYKOMAS qualifying as such.
“Customers”
This means the person, firm or body corporate together with any subsidiary, group or associated company to whom EASYKOMAS commits in terms of products and services.
“Client”
This means the person, firm or body corporate together with any subsidiary, group or associated company to whom EASYKOMAS commits in terms of professional services.
“User”
This means the person, firm or body corporate together with any subsidiary, group or associated company that uses our online platforms, apps or channels.
“E-commerce Franchise Agreement”
This refers to an agreement in any form between the E-commerce Franchisor (EASYKOMAS) and the Franchisee - an individual, group or corporate body who willingly decides to partner with EASYKOMAS on the distribution, marketing or sales of products and services (including the sale of the Franchise itself) on EASYKOMAS E-commerce Marketplace application upon the payment of a Franchise Fee firstly for 5 years before renewal or on a progression according to updated terms. This agreement covers all that is stated both in the EASYKOMAS Franchise Manual and the Terms and Conditions documents, which might otherwise be referred to as the “EASYKOMAS Franchise Agreement”.
“EASYKOMAS Franchise Fee”
This refers to the designated Amount payable by a distributor of EASYKOMAS E-commerce Franchised Marketplace based on package or categorization as may be reflected in the company’s Franchise Manual or Marketing materials.
“Franchise Manual”
This refers to a documentation of the operation, processes, practices, and policies for the distribution of EASYKOMAS E-commerce Franchised Marketplace. It is expected that all Franchisees should be conversant with the details thereof just as it is already made available to all ahead of payment on the dashboard.
“General Disclaimer”
Except for the binding 5-year existential agreement, all distributors/franchisees, customers, clients, or users acknowledge that EASYKOMAS LIMITED, the Management team, or any Staff member assumes no responsibility or liability for any loss concerning access and use of the information provided on our website, app, associated materials and platforms, or from the use of the products and services thereof.
